About EOU schems

Export Oriented Units (EOUs) are specialized units established to promote exports and enhance foreign exchange earnings. The EOU scheme, initiated in 1980, allows units to import raw materials and capital goods duty-free, aiming to boost export competitiveness

Eligibility Criteria

To qualify for EOU status, a unit must:

  • A consolidated application seeking permission for setting up of a Unit and other clearances shall be made to the DC, with a copy to the Developer
  • The DC shall get the proposal scrutinized and get it placed before the Approval Committee for its consideration. The Approval Committee shall meet once in every fortnight on a fixed predetermined day. 
  • The Approval Committee may approve or approve with modification or reject a proposal placed before it, within 15 days, where the approval is to be granted by the Board, the Board shall approve or approve with modification or reject such proposal within 45 days of its receipt
  • The Approval Committee shall approve the proposal if it fulfils the criteria such as meeting NFE, availability of space, conforming to pollution norms, contact and personnel information, barring of specified activities etc.
  • The Letter of Approval (LOA) will be valid for one year within which the unit has to commence the production or service or trading and shall intimate the same to Development Commissioner (DC).

Benefits and Incentives

To qualify for EOU status, a unit must:

  • SEZ units are exempted from the payment of goods and service tax on “zero rated supplies”.  Section 16 of the IGST Act, 2017 categories the following taxable supplies as “zero rated supplies”
  • SEZ units are allowed to import or procure their requirements for capital goods, raw materials, office equipment and other services without the liability to pay any duty on them.
  • Goods which have been procured / imported locally are permitted to be employed over the 5-year approval period.
  • SEZ units can sub-contract a part of their production through other units located in DTA or SEZ or Export Oriented Units  with prior approval of customs authorities.
  • Exemption from other duties under the Customs Act, 1962 or the Custom Tariff Act, 1975 or any other law for the time being in force, on goods imported into, or service provided in, a SEZ or SEZ unit, to carry on the authorised operations by the developer or entrepreneur.
  • Exemption from duties under the Customs Act, 1962 or the Customs Tariff Act, 1975 or any other law for the time being in force, on goods exported from, or services provided, from a Special Economic Zone or from a Unit to any place outside India.
